We would like to inform you about the new law that Spanish Government has brought in. This law is The Royal Decree of April 5th 235/2013 that approves the basic procedure for building performance certifications.
The Decree affects the obligation to make available to the buyers or tenants of buildings an energy performance certificate which must include objective information about the energy efficiency of a building and reference values such as energy requirements in order that the owners or tenants of the building or unit to compare and assess their efficiency energy. Thus, evaluating and comparing the energy performance of buildings will favour the promotion of energy-efficient buildings and energy saving investments.
In addiction, this Royal Decree helps to inform the CO2 emissions by using energy from emission sources in the sector residential, which will facilitate the adoption of measures to reduce emissions and improve the energy rating of buildings.
When buildings or units were sold or rented, the energy performance certificate or a copy of it must be shown to the purchaser or potential new tenant in the terms set out in the basic method. The certificate is included in an Autonomic Registry and is valid for ten years. The Certificate must be present in every piece of promotional material, which encourages people to buy or rent the building, house or commercial premises, and also must be available to interested parties in the form of a digital tag when any property is put on the market.
This law began the first of June, all buildings, houses and commercial premises that are sold or rented must have an Energy Performance Certificate, which can only be issued after assessment by accredited energy technician.
An architect, engineer or quantity surveyor can issue the Energy Performance Certificate. They will access the property and rate it from “A” to “G” according to how energy efficient is.
Not to have this certificate will be a breach of the Royal Decree and will incur sanctions.
Frequently Asked Questions (FAQ)
What is an energy performance certificate?
It is a report that describes how efficient a home is in terms of energy consumption and also gives recommendations on how to save money and make your home more efficient. It assigns an energy rating to each home on a scale, which ranges from “A” (the most efficient) to “G” (the less efficient).
Who needs to get an energy certificate?
All property owners wishing to sell or to rent their properties must have an EPC.
Can I sell or rent without an energy certificate?
No. The certificate must be included in the documentation, which the owner has to make available to the buyer or tenant. Therefore, an original copy of the certificate must be available before the transaction can be closed.
Is the energy certificate needed for all buildings?
No. There are a few exceptions:
a) Buildings and monuments officially protected as part of a designated environment or because of their special architectural or historic.
b) Buildings or parts of buildings used exclusively as places of worship and for religious activities.
c) Temporary buildings with a planned time of use exceeding two years.
d) Industrial buildings, defense and agricultural or parts thereof, in the part for workshops, industrial processes, defense and non-residential agricultural.
e) Buildings or parts of buildings insulated with a total useful floor area of less than 50 m2.
f) Building purchased for major renovations or demolition.
How long is the energy certificate valid for?
The certificate is valid for 10 years. This means owners will not have to obtain a new certificate during this period unless they renovate or change the property in any way.

Zero Energy Solutions is an Andalusian Company offering specialist technical services related to energy efficient and environmentally sustainable solutions for buildings, both existing and new.
Our aim is to promote energy efficiency and sustainable development in the fields of architecture and urban design.
Spain has been the last country of the European Community to adopt the European directive 2010/31/CE, through Real Decreto 235/2013, with reference to the energy certification of buildings, targeted at the regulation of CO2 emissions; the cause of global warming and worldwide natural disasters. This combined with the enormous increase in energy bills, (electricity, gas, heating oil, etc.), makes good sense of our objectives.
We are a team of technical experts that has specialized for some time in this sector. With our training, focused on energy efficiency and environmental sustainability, supported by a wide professional experience in the construction sphere, we are able to offer an integrated assessment, dedicated to your dwelling with imaginative and innovative solutions. We will commit to a comprehensive overview of the energy improvement of your house from a study of the various solutions, through to the works necessary; for example, the upgrade of service installations, new windows, better insulation and so on. Amongst the proposals that we can offer, worthy of mention are the following: biomass boilers, solar cooling systems, evaporative systems, geothermic energy, nocturnal radiation, thermal and photovoltaic solar energy and wind power.
You should know that all of these alternatives are totally ecological, that is to say they do not emit CO2 into the atmosphere or are neutral. So that you, in your own small way would be contributing to the betterment of the health of our planet, the planet which will surely be handed down to our children, a planet healthy and sustainable.
So what can we do at Zero Energy Solutions to help you?
We make an assessment as to the ENERGY EFFICIENCY of your dwelling. If it already has a CERTIFICADO DE EFICIENCIA ENERGE?ÉICA it will be rated by the letters A to G, depending on its emissions of CO2 into the atmosphere; A being the best and G the worst category. These categories are regulated by various factors, the four most important of which are: the constructive and thermal insulation characteristics of the enclosing elements, (walls etc.), the type and glazing of the windows, orientation and the systems of hot water production, heating and cooling.
The current high consumption of energy and the scarcity and diminution of the sources of their production, presently mainly petroleum based, could become a serious problem in the future if appropriate measures are not adopted. The EEC legislation, (2010/31/CE) has as its objective, that all dwellings built after 2020 will be “zero energy efficient”, that is to say, of almost zero energy consumption. What does this mean? Well, soon houses are going to have available a limited number of kilowatt/hours to use, anything over that will have to be self produced by means of sustainable energy systems currently available.
For both new and existing houses the energy categorisation is only the first pass of what is yet to come. A poor categorisation will make it more difficult to sell or rent the property and in comparison to others better categorised its intrinsic value will be less; moreover in other European countries the houses which contaminate the most are going to be penalised through taxation unless they are energy improved.
We at Zero Energy Solutions can help you to avoid these disadvantages by advising on the energy rehabilitation of your house. You should be aware that currently there exists in the marketplace the technical know-how to install in it wholly ecological and environmentally friendly equipment, which can provide a practically zero energy consumption. In our study we will include too, an economic analysis of the pay-back period of your investment. We will also contract to manage on your behalf the relevant subsidies, grants and loans available from the Junta de Andaluci?a and statal authorities for such undertakings. You can also offset up to 20% of the costs of energy improvement in your tax return.
In conclusion, may we pass on to you our best respects and invite you to contact us for a no commitment, free project for the energy rehabilitation of your dwelling.
